“Currently, the company has transferred the production technology and non-exclusive right to use the two above-mentioned rice varieties to Ho Quang Trading and Service Private Enterprise, Tax Code: 2200694077. Address: No. 25, Đường Tỉnh 943, Thạnh Thanh Loi, My Xuyen town, My Xuyen district, Soc Trang province (two enterprises with one family) ”, the text of Ho Quang Tri private enterprise stated.

Temporarily disregarding ST24 rice because this variety has been widely planted, only ST25 has just been granted the Protection Decision No. 45 / QD-TT-VPBH by the Department of Agriculture and Rural Development (MARD). 03/06/2020.

So what is the meaning and value of this protection, the rights of the owners and authors mentioned in this protection will be like, which should be clarified to avoid misunderstandings.

... No brand protection of rice varieties ST25?

According to PV's research, there are currently no laws in the world to protect the trademark of a plant variety because the tree is natural, does not belong to anyone. Specifically, the ST25 rice strain of the Rice-Oryza sativa L ..., means that the authors have successfully bred this rice variety on the basis of the Oryza sativa L Rice ... which the Oryza sativa L Rice ... obviously belongs to. nature.

Therefore, it is not possible to monopolize the trademark of ST25 rice variety (including Ho Quang Tri Private Enterprise). Thousands of small farmers have the right to propagate ST25 rice, have the right to grow ST25 rice varieties and have the right to sell ST25 rice.

Concerning the above content, the Department of Agriculture and Rural Development of Soc Trang province also admitted that currently only protecting ST25 rice, not protecting ST25 rice, so all organizations and individuals have the right to sell this type of rice.

“Trademark rights are only established when based on a decision to grant a protection title, so even though the enterprise has used the ST25 trademark in the market, if it does not apply for trademark registration and the Department of Property intellectual property has not had a decision to grant, then that business has no rights to the ST25 brand, ”he explained.

Don't talk about ST25 fake rice, ST25 fake rice ... in the market. The first thing that needs to be clarified is the consumer view of ST25 rice today. In fact, in addition to Ho Quang Tri Private Enterprise and its affiliated units that are selling ST25 rice, many other individuals and units are also selling this type of rice publicly. So, is this business considered to infringe upon the rights of the author or the owner unit that has been granted a protection certificate?

Market transparency will help ensure fairness in business, create a clean knowledge-economic environment for all rice businesses, while protecting the legitimate rights and interests of thousands of farming households. Small farmers are planting ST25 rice.

It must be emphasized that the first-class ST25 rice becoming the "World's Best Rice" is only the beginning of a long-term strategy of enhancing the value and branding of Vietnamese rice. Therefore, the story of ST25 rice grain is now no longer solely for the research team, or for Soc Trang province, but for the whole Vietnamese rice industry.
